1. Who we are

These Terms of Service ("Terms") govern your access to and use of Eye of Nali ("we," "us," "our"), the website located at eyeofnali.com (the "Site"), and any products you purchase from us. Eye of Nali is operated by Kenny Deniz, a sole proprietor based in Caledon, Ontario, Canada. You can reach us at nalisupport@gmail.com. By accessing the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or purchase from us.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Products, descriptions, and pricing

We try to display our products, colors, and sizing as accurately as possible, but we cannot guarantee that your screen displays colors accurately. Slight variation in color, fabric, print placement, and measurements is normal and is not a defect.

All prices are listed in Canadian Dollars and may change at any time without notice. Prices do not include applicable taxes (such as GST/HST), duties, or shipping unless stated at checkout.

We reserve the right to correct pricing or description errors, and to refuse or cancel any order affected by such an error, even after an order is confirmed. If we cancel an order you already paid for, we will refund that order.

All products are subject to availability. We may limit quantities, discontinue items, or refuse service to anyone at our discretion.

4. Orders and payment

Your order is an offer to buy. We accept it only when we send an order confirmation or ship the item. Payment is processed by our third-party payment providers (for example PAYMENT PROCESSOR, e.g., Shopify Payments / Stripe / PayPal]); we do not store your full card details. You authorize us to charge your chosen payment method for the total shown at checkout, including taxes and shipping.

5. Shipping, international duties, and risk of loss

Shipping times shown at checkout are estimates, not guarantees. We are not responsible for delays caused by carriers, customs, weather, or events outside our control.

For international orders, you are the importer of record. You are responsible for all customs duties, import taxes, and fees charged by your country. We have no control over these charges and cannot predict them. If a package is refused or abandoned because of unpaid duties, we are not obligated to refund it.

Risk of loss passes to you when we hand the package to the carrier. Please make sure your shipping address is correct — we are not responsible for orders sent to an address you entered incorrectly.

6. Returns, refunds, and exchanges

We want you to be happy with your order, but because we are a small independent brand, all sales are final except as described below and except where the law of your country or state requires otherwise.

Change of mind: We do not offer refunds, returns, or exchanges for change of mind, wrong size ordered, or buyer's remorse.

Defective, damaged, or incorrect items: If your item arrives defective, damaged, or is not the item you ordered, contact us at nalisupport@gmail.com within [e.g., 7] days of delivery with your order number and clear photos. If we confirm the issue, we will, at our option, replace the item or refund it.

Refunds, when granted, are issued to your original payment method and may take several business days to appear. Original shipping charges are non-refundable except where required by law.

Sale, clearance, and final-sale items are not eligible for return or refund except where they arrive defective or where the law requires otherwise.

Note for you: In Ontario, the Consumer Protection Act still gives buyers certain non-waivable rights (for example if goods are never delivered or are substantially different from what was described), and EU/UK consumers usually have a statutory 14-day cancellation right regardless of this clause. The "except where the law requires otherwise" wording keeps you from promising something illegal.

7. Intellectual property

All content on the Site — including the Eye of Nali name, logos, designs, graphics, product photos, and text — is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, reproduce, resell, or use our designs or content for commercial purposes without our written permission.

8. User content

If you post reviews, photos, comments, or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and repost that content for marketing purposes with attribution where practical. You are responsible for anything you post and confirm you have the right to share it. We may remove any content at our discretion.

9. SMS / text-message marketing (VIP)

When you enter your phone number in our VIP sign-up box and confirm, you give your express consent to receive recurring marketing text messages from Eye of Nali — Kenny Deniz (such as new drops, restocks, sales, and VIP offers) at the number you provided. This program is operated in accordance with Canada's Anti-Spam Legislation (CASL). Consent is not a condition of any purchase.

  • Every message will identify us as the sender and include a way to unsubscribe.

  • You can opt out at any time by replying STOP to any message (or using the unsubscribe method in the message). We will action opt-outs promptly. Reply HELP for help, or contact us at nalisupport@gmail.com.

  • Message frequency varies. Message and data rates may apply from your carrier.

  • Carriers are not liable for delayed or undelivered messages.

  • You confirm that you are the owner or authorized user of the phone number you provide, that the number is accurate, and that you are giving consent for that number.

  • We keep a record of your consent as required by law. How we handle the personal information collected through SMS sign-up is described in our Privacy Policy.

10. Prohibited uses

You agree not to use the Site to break any law, infringe our or anyone's rights, submit false information, place fraudulent orders, introduce malicious code, or interfere with the Site's operation.

11. Disclaimer of warranties

The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Eye of Nali and Kenny Deniz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you actually paid for the product giving rise to the claim. Some jurisdictions do not allow these limits, so they may not fully apply to you.

13. Indemnification

You agree to indemnify and hold harmless Eye of Nali and Kenny Deniz from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or products.

14. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the courts located in Ontario, Canada, and you consent to their jurisdiction, except where mandatory local consumer law in your province or country grants you the right to bring a claim locally.

15. Changes to these Terms

We may update these Terms at any time. The updated version takes effect when posted on the Site with a new "Last updated" date. Your continued use of the Site or a new purchase after changes are posted means you accept the updated Terms.

16. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remain in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Site and your purchases.
